Sometimes you understand the gravity of a situation when you face it yourself or see someone close facing it. During my childhood before I even learnt driving my family used to advice me on many things for safety, one of the advice I still distinctly remember is “Do not talk to strangers even young females” This was not without any reason as once during my childhood days one of my distant relatives from home town had come to visit us and while driving home in evening he came across a female asking for lift for short distance. Unsuspecting he allowed her in and shortly after reaching a bit secluded spot the lady asked him to hand over all the valuable he was carrying, else she would cry rape so that he will be beaten up by the crowd and jailed. No marks to you for guessing that he handed over whatever he had.

A lady who accuses any one of raping her is assumed to be speaking the truth without investigation on the sanctity of her claims or the mental trauma, loss of reputation and shock that the accused person has to go through which is often a life changing situation though in negative direction. In Delhi court case were Judge R Tewari acquitted 4 persons – 1 female and 4 male in rape case. He remarked that the woman making this claim was a cold blooded thinker. The Accusing lady here was employed in court and should be expected to be more law abiding than the general public, but was opposite she was more keen to play with law and lives of the people unscrupulously. Also in another case a trial court in Delhi has acquitted a man of the charges of raping a woman after it found out the woman and her mother were in a "habit" of lodging false rape cases with ulterior motives. If such a false case is made by a lady with whom a person already has some consensual physical interaction it gets all the more difficult to prove innocence as in case of a north Carolina university student Crystal Gail Mangum who was a stripper and escort, falsely accused three men part of Duke Blue Devils men's lacrosse team of raping her after a party. The players were suspended and their coach had to resign, investigation took one year to complete after which it was proved that the case was false and the men were acquitted. One year of investigation especially in rape case takes heavy toll on a person. The situation is worse in India where such type of cases take 5 to 10 years to be concluded. Even though Magnum was found of making false accusation she did not mend her ways and was implicated in other cases. On April 2 2011 she was arrested of stabbing her boyfriend in North Carolina who died of the resulting injuries. The comment by the minister that most of the rape cases are consensual was a shocker to many because they are living in an imaginary world thinking that a woman's word is gospel truth. A woman and her mother have been ticked off by a Delhi court for their "habit" of lodging false rape cases with ulterior motives, including those for grabbing property. The court, while acquitting a man accused of raping the woman, observed that she and her mother had earlier too lodged several cases of rape, some of which have already been found to be false. My aim for writing this article is to drive home the point that arrests in cases of 498a & DV should not be made by considering a women’s word as gospel truth. There have been so many false cases of Domestic violence and 498a which have lead to suppression of men’s rights that now even judiciary has started to call these laws as means to perpetuate legal terrorism in this country.
